Terms of sale and use
These terms apply when you use cassidyinspired.com or buy from it. The site and shop are operated by Spike-Buster Media LLC, a California limited liability company, trading as Cassidy Inspired (“we”). By placing an order you agree to these terms and to our shipping and returns policy, which is part of them.
Products
Everything we sell is printed to order with original artwork by Cassidy. Product pages describe materials and sizes; small variations in color and finish between the photos and the printed item are normal and are not defects. We may change or withdraw products at any time.
Prices and payment
Prices are in US dollars and exclude shipping and any sales tax, both of which are shown before you pay. Payment is taken in full at checkout through Stripe. We may correct a pricing or description error at any time; if we find one after you’ve ordered, we’ll tell you and let you confirm at the correct price or cancel for a full refund.
Your order
Your order is an offer to buy. We accept it when we send the order confirmation email. We may decline or cancel an order, for example where we suspect fraud, an address can’t be served, or the product is no longer available; in that case we refund in full. You can cancel until the order enters production, as described in the shipping and returns policy.
You’re responsible for giving a correct, complete delivery address and an email address you check. We’re not responsible for delays or losses caused by an incorrect address.
Shipping, delivery and risk
Production and delivery times on the site are estimates. If we can’t ship within 10 days of payment we’ll tell you and offer a full refund. Risk in the goods passes to you when the carrier delivers them to the address you gave.
Returns and refunds
Because items are made to order, we don’t accept returns for change of mind. Damaged, defective or incorrect items are replaced or refunded if you tell us within 30 days of delivery. Full details, including refund timing, are in the returns policy. Nothing in these terms limits rights you have under California or other applicable consumer law.
Artwork and copyright
All artwork, photographs, text and designs on this site are the property of Spike-Buster Media LLC or its licensors and are protected by copyright. Buying a product gives you the physical item for personal use. It doesn’t transfer any rights in the artwork: you may not copy, reproduce, scan, resell as prints, or use the designs commercially without our written permission.
Using the site
You may use the site to browse and buy. You may not use it in any way that breaks the law, interferes with its operation, attempts to gain unauthorized access, or scrapes its content for other purposes. Reviews or messages you send us may be used by us to improve the shop, and reviews may be published on the site with your first name and last initial; you confirm anything you send is your own and accurate.
Our liability
We supply the products with reasonable skill and care. To the fullest extent the law allows, our total liability for any claim relating to an order is limited to the amount you paid for that order, and we’re not liable for indirect or consequential losses. Nothing in these terms excludes liability that can’t be excluded by law, including for death, personal injury, or fraud.
Disputes
If something goes wrong, please contact us first; nearly everything can be put right quickly. These terms are governed by the laws of the State of California, and the courts of Los Angeles County, California have jurisdiction, without affecting your right to bring a claim in your local small claims court.
Changes
We may update these terms; the version in force when you order applies to that order.
